Our clients had owned a timeshare in Tenerife for many years, but as the years went on and their children grew up they found that they were using the resort less and less but still paying the ever increasing maintenance fees. They decided to approach the resort and seek an end to their timeshare. Unsurprisingly, the resort were less than helpful, and simply offered to upsell them to another timeshare holidays points package.

In 2016, our clients were contacted out of the blue by a timeshare termination company who claimed they could get them out of their timeshare and had legally trained professionals that could do this for them. They offered a short break at a hotel and in return, all our clients had to do was attend a short meeting with one of the company’s lawyers.

They arrived at the meeting expecting to meet with an independent specialist legal representative. However, it was quite apparent from early in the meeting that the person to whom our clients met with, was not a legal representative but a sales person.

Our clients were, for the following several hours forced to endure an extremely high pressured sales presentation about the benefits of purchasing a Lifestyle and Leisure package along with a timeshare termination.  They were put under considerable pressure to make a decision there and then, they were not given any time to go away and think about making such a big financial commitment.

Our clients’ only intention in agreeing to attend a meeting with this company was to explore their options in respect of timeshare disposal and nothing more. In reality, our clients were coerced and bullied into purchasing a lifestyle and leisure package, they did not want or had any use for. Having endured several hours of high pressured switch and bait style selling tactics, they reluctantly agreed to purchase the membership.

When they tried to access their new membership, they quickly realised it was a fraudulent scam. None of the so called perks and benefits were of any use to them and in fact, they could find better deals themselves online. This is when they were introduced to Mercantile Claims and happily we have been able to reclaim all of the money our clients paid to this scam company plus interest.

People who enter into Timeshare agreements often find it difficult to keep up with the mounting maintenance fees and simply cannot afford it any longer. They may also find that the Timeshare no longer suits their needs and simply want to end the contract. It is also important to remember that purchasing a Timeshare should NEVER be viewed as a financial investment. Timeshare is an investment in lifestyle, in future holidays and family time together. There is almost no resale value to a Timeshare.

The mis-selling of holiday products is, unfortunately, common practice within the holiday industry and these type of crimes often go unreported by the most vulnerable in our society and criminal convictions are few and far between.
