Today we are delighted to share with you yet another successful claim for one of our clients who have received a settlement of over £8,000.

Our clients had owned a timeshare with Diamond Resorts in Tenerife for nearly 20 years. The unit was sold to them as an investment, but the couple found that it was simply an overpriced way of going on holiday, and as the years went on the resort began to become dilapidated and they began to visit it less and less.

“It was a cheap and nasty resort, never updated even if anything dilapidated. We didn’t enjoy it at all.” In addition to this they found that it was extremely difficult to use and when they approached Diamond seeking to exit from their timeshare, felt threatened by staff.

Unhappy with their timeshare, the couple began to holiday elsewhere, still paying their maintenance fees to Diamond. Whilst holidaying in Malta, this is when they came into contact with a timeshare termination company, who asked them to attend a meeting explain how they could help get them out of their Diamond contract.

The sales representatives at the meeting were very persuasive and promised a lot to our clients. They said they could relinquish their current timeshare and save them the money on rising maintenance fees. In addition as part of the package would offer them 25% off the cost of holidays and discounted items such as utility bills, shopping and cash back on their credit cards.

The meeting lasted for 4 hours and both tired and desperate to be free from their Diamond obligations agreed to enter into the contract. They purchased a membership package for the whopping price of £8,950.

It wasn’t until some months later when our clients attempted to use some of these benefits that they realised they were completely useless and of no benefit to them whatsoever. In their 70’s, they were in no position to benefit from their discounts or lifestyle offers and were sold a product they simply could not use. In addition to this, they learnt that this unscrupulous company had not terminated their timeshare at all, and they were still being pursued by Diamond resorts for unpaid fees.

Fortunately for our clients, they were recommended the services of Mercantile Claims and happily we have been able to reclaim all of the money our clients paid to this scam company plus interest.

People who enter into Timeshare agreements often find it difficult to keep up with the mounting maintenance fees and simply cannot afford it any longer. They may also find that the Timeshare no longer suits their needs and simply want to end the contract. There are too many individuals who are willing to take advantage of Timeshare owners and offer fake products, along with Timeshare exit schemes. Before agreeing to any Timeshare termination or exit procedure with an individual or company, seek independent advice and fully research any company you are thinking of working with.

It is also important to remember that purchasing a Timeshare should NEVER be viewed as a financial investment. Timeshare is an investment in lifestyle, in future holidays and family time together. There is almost no resale value to a Timeshare.

The mis-selling of holiday products is, unfortunately, common practice within the holiday industry and these type of crimes often go unreported by the most vulnerable in our society and criminal convictions are few and far between.
